1. Agreement to Terms

By accessing or using SandDune AI (“the Service”), you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you do not have permission to access the Service.

2. Description of Service

SandDune AI turns your handwritten notes into a private, searchable digital archive. The Service includes:

• AI-powered transcription of handwritten text
• Digital storage of your note images and transcriptions
• Keyword search across your notes
• Ask — AI-generated answers to questions about your notes, with citations to the source pages
• Timelines — recurring questions answered over time as dated, AI-generated entries (“nodes”)
• Notebooks — grouping your notes into collections with optional covers
• Live Highlights — line-level transcribed text anchored to the matching lines of your note image, with tap-to-copy and tap-to-edit
• Automatically generated monthly artifacts summarizing your writing activity, including pages, words, and writing days
• Activity statistics such as streaks and word counts
• Access to both free and premium features

3. Beta Features

Certain features of the Service may be designated as “beta” or “experimental.” Beta features are provided “as is” and may be modified, suspended, or discontinued at any time without notice. We make no guarantees regarding the availability, reliability, or accuracy of beta features.

4. Eligibility

You must be at least 18 years old to create an account and use the Service. By using the Service, you represent that you are 18 years of age or older.

5. User Accounts

To use the Service, you must create an account with accurate, complete, and current information. You are responsible for maintaining the security of your account and password. SandDune AI cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.

6. Subscription and Payments

We offer both free and paid subscription plans. By selecting a paid subscription, you agree to pay all fees in accordance with the pricing associated with the subscription plan you choose. Subscription fees are billed in advance on a monthly basis.

• You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period, and you keep your paid features until then.
• We do not offer pro-rated refunds for partial billing periods.
• Unused monthly quota (transcriptions or Asks) does not roll over to the next billing period.
• If we change subscription prices, we will give you at least 30 days' notice before the new price applies to you.

7. Content Ownership & AI

You retain all rights to your content. By uploading content to SandDune AI, you grant us a license to store, process, and analyze your content solely for the purpose of providing the Service to you. This license ends when you delete your content or your account. We handle all user data in accordance with our Privacy Policy.

• Your content is never used to train AI models — not by us, and not by the AI providers we work with.
• AI-generated outputs (transcriptions, answers, summaries, titles) are generated for you and belong to you.
• AI outputs may contain errors. You can review and edit transcriptions and Timeline entries at any time. SandDune AI is not liable for decisions made in reliance on AI-generated output.

8. Usage Limitations

Your account is subject to usage limitations based on your subscription tier. These limitations apply to transcription services and to question-answering (Ask) — the Ask quota also covers Timeline node generation, so generating a Timeline entry uses one Ask. Please refer to our Pricing Page for current usage limits. Free tier accounts, Smart tier accounts, and Pro tier accounts have specific monthly limits that are strictly enforced, and attempts to circumvent them may result in account suspension. Monthly artifacts are generated automatically and their availability is subject to the Service's scheduled processing.

9. Acceptable Use

You agree not to:

• Upload or store content that is unlawful under applicable law
• Attempt to access, extract, or interfere with other users' data
• Resell, sublicense, or scrape the Service or its outputs
• Circumvent usage quotas, rate limits, or other technical restrictions

10. Service Modifications

We reserve the right to modify or discontinue, temporarily or permanently, the Service with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

11. Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. You may delete your account at any time; upon account deletion, the content license in Section 7 ends and your data is handled as described in our Privacy Policy. All provisions of the Terms which by their nature should survive termination shall survive termination.

12. Limitation of Liability

In no event shall SandDune AI, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
